| Establishing a Representative Office ( RO )

This is the simplest form of legal set up in China for a foreign company, this is not a legal entity in its own right, this type of set up is however very restrictive and will legally only allow representation of the parent
company.
An RO is allowed to engage in non profit making activities such as business liaison, product promotion, market research and quality inspections.
An RO is not allowed to engage directly in operational activities, it is not allowed to transact business (buying and / or selling) and is not allowed to directly employ staff, this has to be done through a government
agency such as FESCO.
An RO is only permitted for 3 years following which it has to make a re-application.
